NPPC Presses for Prop 12 Fix in Farm Bill as Pork Stocks Climb 12%
U.S. pork cold storage is up 12% year-over-year and USDA has trimmed its export outlook. NPPC says the House farm bill carries a Prop 12 fix; the Senate has yet to schedule a vote before the midterm recess.
Market notes
- Pork in cold storage is up 12% from a year ago, per USDA data
- Domestic pork consumption remains below pre-COVID levels
- USDA has lowered its outlook for pork shipments later this year
- The House farm bill version includes language addressing California Proposition 12
- No Senate farm bill vote is scheduled before the midterm recess
The National Pork Producers Council is pressing to attach a California Proposition 12 fix to the farm bill, as U.S. pork supplies swell and export demand softens.
Cold storage holdings of pork stand 12% above year-ago levels. Domestic consumption remains below pre-COVID marks. USDA has trimmed its forecast for pork shipments later this year — a one-two punch that tightens producer margins and raises the stakes on cost-relief measures in the farm bill conference.
NPPC's Rob Brenneman said the House-passed version already carries language addressing Prop 12, the 2018 California ballot measure that set space standards for breeding pigs sold in the state.
What does the House version include?
Brenneman told RFD-TV the council's aim is to merge the House provision with the Senate text in conference.
"We're sitting there with the true fix in the farm bill on the House side. If we can merge those together in conference, come out with something on the other end, which is what our plan is, and we believe we can get that accomplished," Brenneman said. "If the farm bill goes through, we believe we'll be in there on that with the fix of some type through the conference."
Could overturning Prop 12 hurt small producers?
Critics of repeal argue smaller operators depend on Prop 12 premiums to stay in business. Brenneman rejected that framing and warned consolidation risk runs the other direction.
"Some people say that if we take it away, it's going to hurt the small farmer. I will totally disagree. I think it's going to hurt small farmer if it stays in," Brenneman said. "That's the people that we believe, that our goal is keeping business just like the cattle guys. You got to have everybody, the more voices you have, the better off you are."
NPPC's pitch to lawmakers pairs the small-farmer argument with a consumer cost claim. Brenneman said a federal preemption would lower retail pork prices by spreading capital and compliance costs across a single national market instead of absorbing them inside California's borders.
What is the farm bill timeline?
The Senate has yet to schedule a floor vote. Lawmakers face a compressed window — no vote sits on the docket before the midterm recess. That timeline puts pressure on conferees to reconcile the House and Senate titles, including any Prop 12 language, before the current extension expires.
Brenneman said the council will keep meeting with lawmakers during the recess to keep the issue in front of the conference committee. Whether that effort produces language in the final package hinges on how the House and Senate resolve their differences outside the public spotlight.
The supply data sharpens the political math. With 12% more pork in cold storage and USDA projecting softer exports, producer margins lean on cost relief rather than price recovery. Prop 12 compliance costs have shown up in wholesale pork pricing inside California, an outcome NPPC attributes to a fragmented regulatory map.
Brenneman's comments suggest the council views the farm bill conference as the cleanest legislative vehicle for a Prop 12 fix, rather than a standalone rider or appropriations workaround. Whether the conference report clears before the recess will determine whether sow housing rules stay a patchwork or move toward a single federal standard.
