EPA Proposes Reallocating 770M RINs From 2025 SRE Waivers

EPA seeks comment on two proposals to reallocate 770 million RINs from its 2025 small refinery exemption decisions, restoring waived renewable volumes to the RFS pool.

Market notes

  • EPA proposes reallocating 100% of additional 2025 exempted renewable volumes.
  • The waived volumes equal 770 million RINs tied to 2025 SRE decisions.
  • EPA put forward two reallocation proposals and is seeking public input.

EPA is seeking public input on two proposals to reallocate 770 million RINs worth of renewable fuel volumes waived under its 2025 small refinery exemption (SRE) decisions.

The agency framed the action as a full reallocation. One hundred percent of the additional exempted 2025 volumes would move back into the Renewable Fuel Standard compliance pool under either option.

What does the reallocation mean for compliance?

Reallocated RINs shift obligation from exempted small refiners onto the broader pool of obligated parties. Refiners that did not receive exemptions would need to cover the 770 million RINs, tightening RIN supply relative to demand.

For corn growers and ethanol producers, the move matters directly. Volumes exempted through SREs reduce effective demand for renewable fuel; reallocating them restores that demand, provided EPA finalizes the rule.

What happens next?

EPA has opened a public comment window on the two proposals. Stakeholders — refiners, biofuel producers, and grower groups — can weigh in before the agency selects an approach and finalizes the reallocation.

The outcome will settle how much of the 770 million RINs ultimately counts toward 2025 RFS compliance. Biofuel groups will press for full reallocation; refining interests have historically argued exemptions should not be redistributed.

A final decision will determine effective 2025 renewable volume obligations and RIN market balance.
